Official Contest Rules (THE “RULES”)

Samsung Canada – Samsung Experience Store Galaxy Command Contest (THE “CONTEST”)

OPEN TO ALL RESIDENTS OF CANADA

The Contest is sponsored and administered by Samsung Electronics Canada Inc. (“CONTEST SPONSOR”), 2050 Derry Road West, Mississauga, Ontario, L5N 0B9. 

 

Read carefully: This Contest will run in accordance with these Rules.  The Contest Sponsor reserves the right, subject to any required approval of any regulatory authorities, to cancel, amend, modify or terminate this Contest or these Rules at any time in its sole discretion and without further notice.  These Rules and any changes to these rules will be posted at the following Samsung Experience Store locations in Canada: Yorkdale Shopping Centre (3401 Dufferin Street, Unit 508, North York, ON M6A 2T9), and CF Sherway Gardens (25 The West Mall, Unit 3020, Toronto, ON M9C 1B8) (each an “Eligible Store”).

You must comply with these Rules and you will be deemed to have received, understood and agreed to these Rules if you participate in the Contest.

ELIGIBILITY:

No purchase necessary. Void where prohibited. Contest is open to legal residents of Canada, excluding residents of Quebec, during the Contest Period who have reached the age of majority in their province or territory of residence (or, if under the age of majority, have the consent of their parent or legal guardian to participate in the Contest), except employees or agents (and those with whom they are domiciled) and affiliates of Contest Sponsor and its advertising and promotion agencies.

 

CONTEST PERIOD:

Contest begins on Monday July 29, 2024 at 10:00:00AM (EST) and ends on Wednesday September 4, 2024 at 11:59:59PM (EST) (the “Contest Period”).

HOW TO ENTER:

To enter into the Contest, you must complete all of the steps noted below (for an entry to qualify as an ‘Entry” in accordance with these Rules, all four steps have to be completed):

 

a)      Visit a participating Samsung Experience Store location during the Contest Period. The participating Samsung Experience store locations are as follows: Yorkdale Shopping Centre (3401 Dufferin Street, Unit 508, North York, ON M6A 2T9), and CF Sherway Gardens (25 The West Mall, Unit 3020, Toronto, ON M9C 1B8).. 

b)     You will be asked to provide the following information by way of filling out a form on a Galaxy tablet provided to you by the Representative:

a.      First Name

b.      Last Name

c.      Preferred method of contact (either phone # or email, one is mandatory)

d.      Email

e.      Phone Number

f.       Postal Code

c)      The on-device experience through a tablet will include a consent form for you to agree to these Rules and enter into this Contest.

d)     Once you have entered your information as listed above, visit the Galaxy Command Experience section in-store and follow the on device prompts at the available stations. The Galaxy Command Experience is completed at a mounted tablet guiding you through different modules explaining the features of Galaxy AI as part of a larger interactive story. Each participant plays one module at a time until they have reached the end of the interactive story.

e)     Once you agree to the Rules to enter into this Contest, provided your information as listed above, and completed the Galaxy Command Experience, you will then be eligible to take part in the Galaxy Command Experience. The Galaxy Command Experience will take the customer through the key features of the new Galaxy AI on the Z Flip6 and Z Fold6. Upon completion of the experience, the customer will earn one (1) token to play the claw machine Arcade Game, as defined below, for a chance to win Samsung prizes as listed in the PRIZE section.

f)       The claw machine Arcade Game is found adjacent to the Command Experience in the Eligible Stores. Each participant is eligible to receive a maximum of only one (1) token for the claw machine Arcade Game. A participant must fully complete the Galaxy Command Experience, as described above, to completion within a 1-hour window to be eligible to play the claw machine Arcade Game. Once, the participant has met the eligibility to play the claw machine Arcade Game, they will receive one (1) token. Participants must redeem this token within the Contest Period to be eligible to play the claw machine Arcade Game and win a prize.

g)      To play for a prize, the participant will deposit one (1) token into the claw machine. The participant will navigate the machine by using the joystick and Button to align the Key to the winning slot. If the participant aligns the key to the winning slot a card will drop into the Prize collection reservoir, revealing the prize won.  The participant must present the card to a representative at their participating store immediately after they have won to redeem their prize. Upon the completion of the Declaration of Eligibility and Waiver of Liability form, the participant will receive their prize.

 

Each Entry must be made during the Contest Period using the mechanism set out above.  There is a limit of one (1) entry per person per participating Samsung Experience Store in Canada. Entries must be received before the Contest Period expires. Entries that are in any way duplicated, fraudulent, illegible, altered, mutilated or tampered with.

 

By submitting An entry, YOU agree that your entry complies with all conditions stated in these Rules. The RELEASED parties (as defined below) will bear no legal liability, expressed or implied, REGARDING YOUR ENTRY by the CONTEST Sponsor.  THE RELEASED parties SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.

PRIZE:

There will be a total of seventy (70) prizes to be won comprising of ten (10) Galaxy Watch 7 devices and sixty (60) Galaxy Buds3 devices as listed below. Thirty five (35) prizes will be allocated  per Eligible Store comprising of five (5) Galaxy Watch 7 devices and thirty (30) Galaxy Buds3 devices as listed below (each, a “Prize” and collectively the “Prizes”) consisting of:

1. Five (5) Galaxy Watch 7 (SM-L310NZSAXAC) – average retail price $449.99
2. Thirty (30) Galaxy Buds3 (SM-R530NZAAXAC) – average retail price $209.99

Each participant in the Contest shall be eligible to win one (1) prize.  The prize may be substituted by the Contest Sponsor, only with an alternate prize of equal or greater value in the Contest Sponsor’s sole discretion, subject to any required regulatory approvals.

AWARD OF THE PRIZES:

If you are determined by the Contest Sponsor, in the Contest Sponsor's sole discretion, to have failed to comply with these Rules, you will be disqualified from the Contest. 

 

Odds of winning depend upon the total number of eligible Entries received during the Contest Period and the odds set out below.

If you are a selected contestant, you must, before being declared a winner: (i) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing Commandion; and (ii) execute and deliver a Declaration of Eligibility and Waiver of Liability Form (the “Waiver”) before the deadline provided on the Waiver by the Contest Sponsor and in a form acceptable to the Contest Sponsor, confirming your compliance with these Rules, acceptance of the Prize as awarded without substitution, and releasing the Contest Sponsor, advertising and promotional agencies, the Contest Sponsor,; and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively the “Released Parties”) from any liability in connection with this Contest, your participation therein and/or the awarding and use/misuse of the Prize or any portion thereof. If you are under the age of majority in your province or territory of residence, you must have a parent or legal guardian co-sign the Waiver in order to receive a Prize.

Declining a Prize, failing to return one of the Contest Sponsor’s attempts to contact you within the times noted above, failing to comply with these Rules, failing to correctly answer the mathematical skill testing Commandion or failing to execute and deliver to the Contest Sponsor the Waiver within the specified time will cause the Prize to be forfeited by you and a new random draw from the remaining eligible entries will be conducted to select another contestant in accordance with the provisions noted above.

 

GENERAL CONDITIONS:

AGREEMENT: By entering the Contest, you agree to the publication, reproduction and/or other use of (i) your name, city of residence, statements about the Contest, and photograph or other likeness, without further notice or compensation, in any publicity or advertisement carried out by the Contest Sponsor or its advertising and promotion agencies in any manner whatsoever, including print, broadcast or on the Internet. 

 

All Entries become the property of the Contest Sponsor and shall in no case be acknowledged upon receipt or returned to you.  This Contest is subject to all applicable federal, provincial, territorial and municipal laws and regulations.  The decisions of the Contest Sponsor with respect to all aspects of this Contest are final and binding on you without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.

 

PRIZE: The Prize does not include any ancillary services, products or data usage or other plans whatsoever.  The Prize is provided “as is”, and, except with the manufacturers standard warranty provided with the Prize, is without any representations, warranties or conditions whatsoever, express or implied, and the Contest Sponsor expressly disclaims any and all such representations, warranties and conditions.  Contest Sponsor is responsible for delivery of the Prize within a reasonable period of time. If you are a selected contestant, you are solely responsible for the reporting and payment of any taxes related to the receipt of the Prize.

 

RESPONSIBILITY: The Contest Sponsor does not assume any responsibility for lost, stolen, delayed, damaged, illegible or misdirected entries or entries that have been submitted through illicit means or do not conform to these Rules, or for failure of the Contest website during the Contest Period, or for any problems or technical malfunction of any telephone network or lines, computer systems, servers, access providers, equipment, software, or for failure of any email or for traffic congestion on the internet or at any website, or any combination of any of these, or for any injury or damage to your computer or that of any other person including where such injury or damage is related to or arising from submitting an entry or playing or downloading any material in connection with this Contest. 

 

The Contest Sponsor reserves the right, in its sole discretion, to cancel or modify this Contest should the technological security, physical security or proper administration of the Contest be compromised for any reason.

 

You may be required to provide proof that you are the authorized account holder of the email address associated with the selected entry and that you have all necessary consents, permissions and/or licenses as required by these Rules.    All entries are subject to verification by the Contest Sponsor in its sole discretion.  The Contest Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsor) to participate in this Contest.  Failure to provide such proof in a timely manner may result in disqualification.  You may also be required to provide proof that you are the contestant in respect of the selected entry.  The Contest Sponsor reserves the right, in its sole discretion, to disqualify any individual (and all of his or her entries) who tampers with the entry process. ANY ATTEMPT BY YOU OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE CONTEST SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

RELEASE AND INDEMNITY: By entering this Contest, YOU HEreby release and hold harmless each of the released parties from any liability, claim OR damage (INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, BODILY INJURY, DISABILITY, DEATH, PROPERTY DAMAGE AND LOSS OR DAMAGE OF ANY OTHER KIND) arising DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, from or in connection with this Contest or participation in any Contest related activities, or any breach of YOUR representations and warranties, OR ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF PERSONAL INFORMATION, OR ANY ALLEGATION THAT YOUR ENTRY VIOLATES ANY THIRD PARTY INTELLECTUAL PROPERTY RIGHT or, if declared a winner, The prize (INCLUDING ANY USE OR MISUSE OF The PRIZE).

 

YOU WILL HOLD ALL OF THE RELEASED parties HARMLESS IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.

 

this RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR THE AWARDING OF THE PRIZE.

 

PERSONAL INFORMATION: The Contest Sponsor is collecting personal information about you for the purpose of administering this Contest.  Your personal information will be used for the administration of the Contest, including contacting selected contestants, the awarding of the Prize and in aggregated, non-personal form in order to create reports regarding contestant demographics and consumer habits, which reports the Contest Sponsor may disclose to others.  By entering this Contest, you consent to the collection, use, storage, sharing and disclosure by the Contest Sponsor (and its officers, directors, employees, agents or representatives) of the personal information provided by you in Contest entries in accordance with the Contest Sponsor's privacy policy (available at http://117.p.syniva.es/ca/info/privacy.html) and the Rules.

 

INFORMED CONSENT AND PUBLICITY CONSENT: By entering this contest, you authorize the Contest Sponsor the unrestricted and irrevocable right to photograph and otherwise record your image and likeness during and in connection with your participation in the Contest, in which you have voluntarily agreed to participate; and (2) grant to the Contest Sponsor the unrestricted and irrevocable right to use, publish, reproduce, edit, adapt, modify, exhibit, project, distribute, publically display, create derivative works and otherwise exploit such photographs and recordings, and your name, image, likeness, and appearance (collectively, the “Program Content”), for any and all purposes, including without limitation promotional and other commercial purposes, in any form of media now known or later developed (including without limitation print, digital, electronic, visual, broadcast, Internet and social media, or otherwise), individually and in conjunction with other content, throughout the world and beyond into perpetuity.

You release and waive any claims whatsoever in connection with the use of the Program Content as expressly authorized above, including, without limitation, any claim of rights of privacy, publicity, copyright infringement, defamation, moral rights, or credit. You also release and waive any right you may have to inspect or approve the Program Content or any use thereof as expressly authorized above. Additionally, you waive the right to any royalties or other compensation arising or relating to the use of the Program Content.

You understand and agree that the photographs and recordings created during and in connection with the Contest will become the property of the Contest Sponsor, including the copyrights therein, and that the Contest Sponsor shall have the right, but no obligation, to use the Program Content as expressly authorized hereunder.

You hereby hold harmless and release and forever discharge the Contest Sponsor and all persons, corporations or legal entities acting with its permission or upon its authority, from any and all claims, demands, and causes of action which you, your heirs, representatives, executors, administrators, or any other person acting on your behalf or on the behalf of your estate have or may have by reason of this agreement or the use of the Program Content as authorized hereunder.

You acknowledge that the Contest Sponsor is conducting its activities in express reliance upon the foregoing, and you represent and warrant that you are free to grant the rights granted to Contest Sponsor hereunder, unencumbered and without reservation and that you are not a party to any other existing agreement which would prevent you from entering into this agreement or granting the above rights to Contest Sponsor or which would cause the terms of this agreement not to have full force and effect.  You further represent and warrant that any statement that you make with respect to my positive opinion or endorsement of the Samsung brand and/or Samsung products is a true reflection of your beliefs, findings and opinions.

 

SEVERABILITY: If any provision of these Rules or its application to any entrant or circumstance is determined by a court of competent jurisdiction to be illegal, invalid or unenforceable, it will be ineffective only to the extent of its illegality, invalidity of unenforceability without affecting the validity of the enforceability of the remaining provisions of these Rules and without affecting its application to other entrants or circumstances.
