Samsung Electronics Philippines Corporation Privacy Notice

This Privacy Notice (“Notice”) sets out the basis upon which Samsung Electronics Philippines Corporation(“we”, “us” or “our”) collects, uses, discloses or otherwise processes Personal Data of our data subjets in accordance with this Notice and the Philippine Republic Act No. 10173, otherwise known as the “Data Privacy Act of 2012” and its implementing rules and regulations(“DPA”).

Personal data may be shared among Samsung affiliates and our third party vendors and service providers (e.g., Samsung SDS, Shilla Travel, or Cheil) for the purposes described in this Privacy Notice. The term "affiliates" refers to companies related to Samsung Electronics Co., Ltd, and its related corporations and sister companies (e.g., Samsung HR Shared Service Center and in other companies around the world).

This Notice applies to Personal Data in our possession or under our control, including Personal Data in the possession of organisations which we have engaged to collect, use, disclose or process Personal Data for our purposes described in this Privacy Notice.

Terms used in this Notice shall have the meanings given to them in the DPA (where the context so permits).

APPLICATION OF THIS NOTICE

1. This Notice applies to all persons engaged (or to be engaged) in a contract of service with us (whether on a part-time, temporary or full-time basis), job applicants/candidates, dispatchers, interns and trainees working at or attached to us, and outsourced personnel hired through an agency (collectively referred to as “data subjects”), and all references to “relations” shall apply equally to job applicants/candidates, internships, traineeships and outsource personnel relationships (as may be applicable).

PERSONAL DATA

2. As used in this Notice, “Personal Data” means data, whether true or not, about an data subjects who can be identified through any printed or handwritten document, CCTV footage, ID Card accessible gantries (known as Speed Gates), sound recording or computer file: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.
3. Personal Data which we may collect in the context of your relations with us includes, without limitation, your:
 
(a) name or alias, gender, government id, tax identification or passport number, marital status, religion, date of birth, nationality, and country and place of birth;
(b) mailing address, telephone numbers, email address and other contact details;
(c) employment and training history;
(d) salary information and bank account details;
(e) details of your next-of-kin, spouse and other family members;
(f) details of your emergency contact;
(g) work-related health issues and disabilities;
(h) records on leave of absence from work;
(i) photographs and other audio-visual information;
(j) performance assessments and disciplinary records; and
(k) any additional information provided to us by you as a data subject

COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA

4. We generally collect Personal Data that:
 
(a) you knowingly and voluntarily provide in the course of or in connection with your employment or job application with us, or via a third party who has been duly authorised by you to disclose your Personal Data to us (your “authorised representative”, which may include your job placement agent or recruiter); or
(b) collection and use of Personal Data without consent is permitted or required by the DPA or other laws.
5. Your Personal Data will be collected, used, or processed by us for the following purposes:
 
(a) performing obligations under or in connection with employment laws and you’re approved or prospective contract of employment with us, including payment of remuneration and tax;
(b) all administrative and human resources and personnel related matters within our organisation, including administering payroll, participating in our benefits, compensation and human resource plans and programs (such as corporate travel programs and staff purchase), granting access to our premises and computer systems, processing leave applications, administering your insurance and other benefits, processing your claims and expenses and developing human resource policies;
(c) compliance monitoring and reporting, internal audits and investigating any acts or defaults (or suspected acts or defaults);
(d) managing and terminating our relations with you, including monitoring your internet access and your use of our intranet email to investigate potential contraventions of our internal or external compliance regulations, and resolving related grievances;
(e) assessing and evaluating your suitability for relations/appointment or continued employment/appointment in any position within our organization (including conducting credit, character and other background checks), performance management;
(f) ensuring business continuity for our organisation in the event that your relations with us is or will be terminated;
(g) your safety and security;
(h) to collate, process and disseminate statistics based on held on your personal files;
(i) facilitating any proposed or confirmed merger, acquisition or business asset transaction involving any part of our organisation, or corporate restructuring process;
(j) facilitating our compliance with any laws, customs and regulations which may be applicable to us; and
(k) such other purposes related to or incidental to your relations with us.
6. The purposes listed in the above clauses may continue to apply even in situations where your relations with us (for example, pursuant to a contract of employment) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).
7. If we wish to use your Personal Data for purposes other than those specified above or to which there is no applicable exception under the DPA, we will inform you of the purpose and seek your consent.

ACCESS TO AND CORRECTION OF PERSONAL DATA

8. If you wish to make:
 
(a) an access request for access to a copy of the Personal Data which we hold about you or information about the ways in which we use or disclose your Personal Data, you may submit your request in writing or via email to our Data Protection Officer at the contact details provided below; or
(b) a correction / update request to correct or update any of your Personal Data which we hold, you may contact the Human Resources Department to find out how you can correct/update your records.
9. We will respond to your access request as soon as reasonably possible. Should we not be able to respond to your access request within thirty (30) days after receiving your access request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the DPA).
10. Please note that depending on the request that is being made (i.e., when the burden or expense of providing access would be disproportionate to the risks to your privacy in the case in question, or where the rights of other persons would be violated) we will only provide you with access to the Personal Data contained in the documents requested, and not to the entire documents themselves. In those cases, it may be appropriate for us to simply provide you with confirmation of the Personal Data that our organisation has on record, if the record of your Personal Data forms a negligible part of the document. Access to Personal Data may be denied when the Personal Data is collected, used or disclosed for evaluative purposes.

PROTECTION OF PERSONAL DATA

11. To safeguard your Personal Data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of Personal Data by us, and disclosing Personal Data both internally and to our authorised third party service providers and agents only on a need-to-know basis.
12. You should be aware that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

ACCURACY OF PERSONAL DATA

13. We generally rely on Personal Data provided by you (or your authorised representative). In order to ensure that your Personal Data is current, complete and accurate, please update the Human Resources Department if there are changes to your Personal Data.

RETENTION OF PERSONAL DATA

14. We may retain your Personal Data for as long as it is necessary to fulfil the purposes for which they were collected (not exceeding a period of 10 years from date of cessation or termination of relations), or as required or permitted by applicable laws.
15. We will cease to retain your Personal Data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purposes for which the Personal Data were collected, and are no longer necessary for legal or business purposes.

TRANSFERS OF PERSONAL DATA OUTSIDE OF THE PHILIPPINES

16. Your Personal Data may be used, processed, and transferred outside of the Philippines to Samsung affiliates such as Samsung Electronics Co., Ltd, and its related corporations and sister companies (e.g., Samsung HR Shared Service Center and in other companies around the world) or to our third party vendors and service providers (e.g., Samsung SDS, Shilla Travel, or Cheil).

ADDITIONAL PROVISIONS

17. CCTV and Speed Gate. We have in operation within the around our premises:
 
(a) Closed Circuit Television (CCTV) security cameras for security and crime prevention purposes and to protect the health and safety of employees and visitors; and
(b) ID Card accessible gantries (also known as Speed Gates) to monitor and manage employee and visitor access to the premises and to protect the health and safety of employees and visitors.
18. Contacting Data Subjects after cessation of relations. We may or its representatives may contact you regarding work related matters after cessation of your relationship with us (e.g., cessation of employment).
19. Government Identification. We collect, use, disclose, process and store your government id number and a copy of your government id card, as it is necessary for us to accurately establish and verify your identity to a high degree of fidelity (e.g., payment of government-mandated contributions, reporting to BIR and other government-related Portal/s, management of employee insurance, etc.).

22. This Notice applies in conjunction with any other policies, notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your Personal Data by us.
23. Except for substantial changes in this Notice which may affect your fundamental rights under the DPA-- We may revise this Notice from time to time without any prior notification. You may determine if any such revision has taken place by referring to the date on which this Notice was last updated. Your continued relations with us constitutes your acknowledgement and acceptance of such changes.
