Terms & Conditions

1. These terms

1.1. What these terms cover. These are the terms and conditions on which you may take part in our Samsung Device Trade-in Program (“Trade-in Program”), which provides you with the option to get a reduction in price for selected new Samsung Galaxy devices (“New Device”) purchased through Samsung.com/ph or through Samsung’s Shop mobile app (“the website/app”), either purchased outright or through a credit facility, in exchange for trading in your existing device (the “Existing Device”). The Trade-in Program is offered subject to New Devices being in stock and available in the website/app. The list of acceptable Existing Devices is as listed in the “Select your device” section of the Trade-in Program user interface in the website/app. The list of acceptable Existing Devices will vary, depending on which new device you wish to purchase.  The level of discount which you may receive will vary, dependent on the model of Existing Device you trade in and the condition of your Existing Device. The offer is limited to one New Device per order, and the website/app may prevent you from choosing the option to trade-in for more than one New Device. Any further orders of New Devices under the Trade-in Program may likewise be rejected at our sole discretion. We may also refuse to accept any orders placed for New Devices (or cancel any such orders prior to dispatch) using this Trade-in Program where we have reasonable grounds to suspect fraud. 

1.2. Why you should read them. Please read these terms carefully if you would like to take part in the Trade-in Program. These terms tell you the conditions of the Trade-in Program and other important information. These terms and conditions have been updated as of June 18, 2024.

2. The trade-in program - overview

2.1. How to take part in the Trade-in Program. On placing your order for a New Device, you may choose the Trade-in option if available on the product or checkout page on the website/app. You must completely and accurately input information about your Existing Device, as this will be subject for physical assessment by our assigned trade-in courier and trade-in partner. Based on the condition of your Existing Device, you will be provided with the initial trade-in value that will be deducted as a discount from the price of the New Device upon checkout. If you are successful in completing the checkout process with the trade-in discount, and with successful payment via our payment service provider and order confirmation generated from the website/app, you will be able to take part in the Trade-in Program.

2.2. The offer to take part in the Trade-in Program is available to individual consumers only; it is not available to business/corporate customers.

2.3. Your participation in the Trade-in Program is subject to you providing the Existing Device to our assigned trade-in courier upon delivery of the New Device. Our courier will re-assess the actual condition and details of the Existing Device based on your initial declaration before you completed the order checkout. Our courier will be coordinating the re-assessment with our Trade-in partner, Bolttech Device Protection Philippines Inc. (“Bolttech”), who will either confirm the final trade-in value to be the same as the initial trade-in value, or provide a different final trade-in value based on the actual condition of the Existing Device.

2.4. Should the final trade-in value prove lower than the original, you may choose to pay the variance or “trade-in discount deduction” through a payment link to be generated and sent by authorized personnel of Bolttech via email billing. Your contact information would have been shared in advance by Samsung to Bolttech for this purpose, so you are advised not to share such or any other personal or payment information to the courier or Bolttech. Please note that it is your responsibility to ensure that you are accessing the correct payment link, and the details like your order number and the amount to be paid are correct. There will be no other payment method available apart from this payment link, and cash payment to the courier or transfer of money to any account is not accepted and will not be the liability of Samsung.

2.5. Should you refuse to pay the trade-in discount deduction based on the final trade-in value, we will consider your trade-in order and the New Device delivery to be cancelled. For any concern you may have regarding the failed trade-in, you shall contact Samsung via the contact options provided here.

2.6. Other than as specified in these terms and conditions, our standard Online Shop Terms and Conditions of Sale (which can be found here) will govern your purchase of the New Device and any other products purchased from our website/app.

3. Trading in your existing device

3.1. If you decide to take part in the Trade-in Program, you must provide your Existing Device to us.

3.2. Please note that the option to receive the full value of discount for your Existing Device is only available if your Existing Device meets the requirements set out below (“Minimum Requirements”). Please note that if you are trading in a broken or faulty Existing Device the terms of clause 3.4 apply instead of these Minimum Requirements.

Minimum Requirements

The Existing Device must be owned by you, must match the make, model, and condition you declared prior to order checkout, and must also meet the following functionality criteria:

  • It must power on/up and hold charge
  • It must be fully functional and must have no software or hardware faults
  • It must only have normal wear and tear - there must be no damage or blemishes to screen/LCD and the casing around the device including the camera lens must not be cracked.
  • It must have a fully functioning display and have no cracked screen
  • It must have no signs of screen burn, ghost imaging, discoloration, colored hues or image retention
  • It must be factory reset and have no software locks - the device must have any personal account locks removed and the device must be reset to remove personal data, all devices must have their iCloud or Google accounts removed or custom MDM accounts removed.
  • It must not be PIN locked and must not have an ‘Activation Lock’ or 'iCloud Lock' activated
  • It must include its battery within the casing and must not have any missing parts
  • It must not be crushed or bent in half
  • It must not have an outstanding credit or finance balance associated with it
  • It must not be “jail-broken” or “Knox warranty void” and the firmware must not have been altered
  • It must not have been stolen, or acquired/derived from the proceeds of, or through any criminal activity such as robbery, theft, and other similar illegal circumstances
  • It must be original and meet the manufacturer’s original specifications (and is not personalized with any custom engraving). For example, the entire color of the device must match the original manufacturer’s specification.

3.3. Please note that we, through our trade-in courier, inspect all Existing Devices that are provided as part of the Trade-in Program. If the Existing Device which you are proposing to trade-in does not meet the Minimum Requirements (or the present condition does not match the Existing Device information you declared prior to order check-out), then Bolttech, through our trade-in courier, will provide a final trade-in value based on the reassessment of the actual Existing Device. You may opt to proceed with the transaction or opt out of the Trade-in Program, following clauses 3.4 to 3.6.

3.4. Should your Existing Device not meet the requirements detailed above (with the exception of stolen devices and similar illegal circumstances), you may still trade in your Existing Device by declaring the defects via the assessment questionnaire during the trade-in process on our website/app. Where you are trading in a defective Existing Device, a lower trade-in value will be given as a discount. Please note that we cannot accept defective Existing Devices where:

  • It cannot be powered on/up or hold charge
  • It is deemed not original and does not meet the manufacturer’s original specifications (or if it is personalized with any custom engraving). For example, if the entire color of the device does not match the original manufacturer’s specification.
  • Device touch screen is not working (cracked/scratched screen or screen burn is accepted as long as it still functioning).
  • The Existing Device has an outstanding credit or finance balance associated with it.

3.5. If the trade-in can proceed after reassessment, and if you have made the payment for the trade-in discount deduction (if necessary), you will be asked to sign the Acknowledgment and Declaration of Ownership Form that includes your agreement to surrender your Existing Device within two (2) working days from the date of delivery of the New Device, failing which, your New Device will be subject to the penalty detailed in clause 3.8. Our trade-in courier will hand over the New Device to you after signing your agreement. Note that the courier will no longer wait for you to do your data transfer/backup and re-setting of the Existing Device after handing over the New Device. 

3.6. At the point at which you have provided your Existing Device to us, and you have confirmed receipt of the New Device by signing the Delivery Receipt, ownership in the Existing Device will pass from you to us (or a third party nominated by us). Return of the New Device will only be accepted for valid reasons indicated in our Return Policy detailed in our Online Shop Terms & Conditions.

3.7. Our trade-in courier or customer service agent will coordinate with you for the Existing Device collection schedule. 

IMPORTANT REMINDER: Courier reserves at all times to re-validate the Existing Device.

Please ensure that you will be surrendering the exact same Existing Device in the same condition as inspected/validated previously by our trade-in courier. The courier assigned to collect it will perform the same inspection to re-validate your device, and surrendering the wrong device will result to collection failure and will be subject to the penalty as detailed in clause 3.8. Upon final acceptance of your Existing Device, you will be asked by the courier to sign the same Acknowledgment Form to document the collection.

Please ensure that you back up any photos, files and other data which you have stored on the Existing Device, perform factory reset, and remove the sim card and memory cards before handing over the Existing Device to our courier. On receipt of the Existing Device, all data stored on it will be securely wiped. We are not able to recover any data stored on an Existing Device which has been provided to us. Samsung will not be liable for any lost sim or memory cards lost in the process.

3.8. Failure to surrender the Existing Device within the given period will be considered default, for which Samsung has the right to remotely lock your New Device using Knox Guard. 

3.9. In the case that you are no longer able to surrender the Existing Device, you will be given the option to pay back the full forfeiture fee equivalent to the residual value based on last assessment of the device, plus the full overtrade discount amount, as the trade-in offer will be considered forfeited. You can pay the amount through a payment link to be generated and sent by authorized personnel of Samsung via email billing. You are advised to NOT share your payment information to make this payment. Please note that it is your responsibility to ensure that you are accessing the correct payment link, and the details like your order number and the amount to be paid are correct. There will be no other payment method available apart from this payment link, and cash payment to the courier or transfer of money to any account is not accepted and will not be the liability of Samsung.

3.10. For New Devices that will be remotely locked, Samsung will no longer accept the overdue surrender of the Existing Device. You will be given 15 calendar days to pay back the forfeiture fee via the payment method described in clause 3.9, after which the New Device will be perpetually locked in case of non-payment. 

3.11. Samsung reserves the right to block any future online orders (with or without trade-in) of customers with unsettled trade-in forfeiture fees.

LEGAL DISCLAIMER AND INDEMNIFICATION:

The Trade-in Program shall be subject to our continuous adherence to any applicable law, rules and regulations.

Your surrendering of your Existing Device shall always be subject to our Right to verify ownership of your Existing Device, such as but not limited to, asking for documentary proof that you have legal ownership or possession of the Existing Device. You, as the declared lawful owner of the Existing Device, shall hereby indemnify and hold harmless Samsung, its affiliates, officers, employees, authorized personnel or contractors from any and all claims, including legal implications or liabilities, arising from your breach of this terms and any form of untruthful statement or misdeclaration of such fact pursuant hereunder.

Upon discovery that you have breached or misdeclared ownership or lawful possession of the Existing Device, we reserve the right at any time to withhold, suspend or terminate the Trade-In Program against your account, without prejudice to any and all rights or remedies available to us and/or actions as warranted by applicable laws.

4. Your rights

4.1. Entering into the Trade-in Program does not prevent you from exercising your rights to cancel your order prior to the order shipment or prior to the delivery or completion of the trade-in process (if the order is already shipped).

4.2. Full information about your rights to return a defective product in line with our Returns Policy can be found in our standard Online Shop Terms and Conditions of Sale, which can be found here.

4.3. If you exercise your right to return your product, and if we have deemed it valid for return and refund based on our Returns Policy, the refund will include the final trade-in value of the Existing Device. We will no longer be able to return the Existing Device, as we cannot guarantee it will be returned in the exact same condition. All refunds for valid returns will be paid via check payment and will take up to 10 working days to process.

4.4. Taking part in the Trade-in Program does not affect any statutory rights you may have, including your rights under the Consumer Act of the Philippines.  

5. How we may use your personal information

5.1. How we will use your personal information. We will use the personal information you provide to us in accordance with the terms of our privacy policy, which can be found here: https://117.p.syniva.es/ph/info/privacy/

If you wish to withdraw your consent to us processing your personal data, please contact us using one of the contact methods mentioned on the privacy policy page or via the contact options provided here.

5.2. Please note that in order to take part in the Trade-in Program, you must have a Samsung account and use it to login, or at least provide the necessary shipping information to complete an order as a Guest. As covered by our privacy policy, we share your shipping and contact information to our delivery partners for the purpose of delivering the New Device, as well as to Bolttech, for the purpose cited in clause 2.4.

5.3. If, in the course of taking part in the Trade-in Program, you elect to opt to pay via any of the available third-party financing or microloan options, you will be redirected to the website of the finance provider. The privacy policy and terms and conditions relevant to that finance provider can be found on its website.

5.4. We will only give your personal information to other third parties where the law either requires or allows us to do so. 

6. Other important terms

6.1. Other than Bolttech, in relation to clauses 3.3 and 3.4, nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

6.2. To be eligible to participate in the Trade-in Program, you must be a Philippine resident aged 18+ (or have obtained your parent or guardian’s consent to the relevant sale for the relevant sum).

6.3. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

6.4. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Philippine laws and any dispute, controversy or claim shall be settled by courts in Taguig City, Philippines.
