Terms & Conditions

1. These terms

1.1. What these terms cover. These are the terms and conditions on which you may take part in our Samsung Trade-up Program (“Trade-up Program”), which provides you with the option to get a trade-up reduction in price for selected new Samsung products (“New Product”) purchased through Samsung.com/ph and the Samsung Shop mobile app (“the website/app”), either purchased outright or through a credit facility, in exchange for trading in/turning over your an old product of the same category  (the “Old Product”). The Trade-up Program is offered subject to New Products being in stock and available in the website/app. The list of acceptable Old Products is as listed in the Trade-up Program user interface in the website and may vary depending on the New Product you wish to purchase.  The level of trade-up discount which you will receive may also vary depending on the brand and specifications of your Old Product. The offer in this Program is limited to ONE (1) Old Product to be traded up per order, and the website may prevent you from choosing the option to trade-up to more than one New Product. Any further orders of New Product under the Trade-up Program may likewise be rejected at our sole discretion. We may also refuse to accept any orders placed for New Products (or cancel any such orders prior to dispatch) using this Trade-up Program where we have reasonable grounds to suspect fraud or unlawful activity, including breach of these Terms and Conditions. 

1.2. Why you should read them. Please read these terms carefully if you would like to take part in the Trade-up Program. These terms tell you the conditions of the Trade-up Program and other important information. By availing of the Trade-up Program, you acknowledge that these Terms and Conditions fully apply

2. The Trade-up Program – overview

2.1. How to take part in the Trade-up Program. Upon placing your order for a New Product, you may choose the trade-up option if available on the product or checkout page on the website. You must completely and accurately input information about your Old Product, as this will be subject for physical checking by our delivery partner. Based on the brand and specifications of your Old Product, you will be provided with the trade-up incentive that will be deducted as a discount from the price of the New Product upon checkout. If you are successful in completing the checkout process with the trade-up discount, and with successful payment via our payment service provider and order confirmation generated from the website, you will be able to take part in the Trade-up Program. The trade-up discount that you receive is an incentive and not a trade-in value of your old appliance. The trade-up incentive may or may not be used in conjunction with other ongoing promotions and this depends on the respective promotion mechanics, which differ on a case-to-case basis.

2.2. The offer to take part in the Trade-up Program is available to consumers only; it is not available to business customers.

2.3. A third party logistics provider (“3PL”) may be appointed to fulfill the delivery of your order, which may include collection/disposal service, if applicable. By using/subscribing to the Trade-up Program, you agree and accept that we have your permission to collect, use and disclose/transfer/share your personal information with the 3PL in accordance with our privacy policy available here. Upon delivery of the New Product, the 3PL will check the actual brand and specifications of your Old Product based on the information you submitted before you completed the order checkout.

2.4. Should your Old Product be unavailable for collection or should it not match the brand or specifications declared in your trade-up order, we will consider your trade-up order and the New Product delivery to be cancelled. For any concern you may have regarding the failed trade-up, please immediately contact Samsung via the contact options provided here. There will be no option for you to pay back the trade-up discount in order to continue with the delivery, and any cash payment to the 3PL or transfer of money to any account shall not be accepted and will not be the liability of Samsung.

2.5. Other than as specified in these terms and conditions, our standard Online Shop Terms and Conditions of Sale (which can be found here) will govern your purchase of the New Product and any other products purchased from our website.

3. Trading up your Old Product

3.1. If you decide to take part in the Trade-up Program, you must provide your Old Product to us or our 3PL for collection/disposal. Once collected, the Old Product cannot be returned to the Customer and you will not receive any further amount or value for the Old Product.

3.2. Collection of Old Product will be made at the same time and date of the delivery (“Delivery Time”) of New Product. Customer shall ensure that the Old Product is fully uninstalled (including wiping all data, as applicable) and ready for collection at the customer’s door or agreed collection point at the designated address during the Delivery Time, failing which, Samsung/3PL reserves the right to not collect the Customer’s Old Product and cancel the delivery. *Samsung does not collect or store any personal data contained or stored in the old TV.

The maximum waiting time that will allocated for the delivery, including Old Product assessment and collection, will be thirty (30) minutes, counted from the arrival of our delivery partner at the delivery location. 

In the event the Customer requires the assistance to uninstall/dismantle the Old Product, the Customer may make separate arrangements with Samsung Customer Service subject to additional charges to be agreed and paid directly by the Customer to the assigned Authorized Service Center.
 

3.3. Please note that the incentive to receive the full trade-up discount will only apply if your Old Product meets the requirements, specifically, that the Old Product must be owned by you and must match the brand and specifications you declared prior to order checkout. 

3.4. Should your Old Product not meet the brand and specifications declared (with the exception of stolen devices and similar illegal circumstances), we reserve the right to cancel the delivery and your order as indicated in Clause 2.4.

3.5. At the point at which you have provided your Old Product to us, and you have confirmed receipt of the New Product by signing the Delivery Receipt, ownership in the Old Product will pass from you to us (or a third party nominated by us).

Legal Disclaimer and Idemnification

The Trade-up Program shall be subject to our continuous adherence to any applicable law, rules and regulations.

Your surrendering of your Old Product shall always be subject to our Right to verify ownership of your Old Product, such as but not limited to, asking for documentary proof that you have legal ownership or possession of the Old Product. You, as the declared lawful owner of the Old Product, shall hereby indemnify and hold harmless Samsung, its affiliates, officers, employees, authorized personnel or contractors from any and all claims, including legal implications or liabilities, arising from your breach of this terms and any form of untruthful statement or misdeclaration of such fact pursuant hereunder.

Upon discovery that you have breached or misdeclared ownership or lawful possession of the Old Product, we reserve the right at any time to withhold, suspend or terminate the Trade-up Program against your account, without prejudice to any and all rights or remedies available to us and/or actions as warranted by applicable laws.

By availing of the Trade-up Program, you agree to hold harmless Samsung, its affiliates, officers and personnel from any and all damages brought about by your non-conformity to these terms and conditions.

4. Your rights

4.1. Entering into the Trade-up Program does not prevent you from exercising your rights to cancel your order prior to the order shipment or prior to the delivery or completion of the trade-up process (if the order is already shipped).

4.2. Full information about your rights to return a defective product in line with our Returns Policy can be found in our standard Online Shop Terms and Conditions of Sale, which can be found here.

4.3. If you exercise your right to return your New Product, and if we have deemed it valid for return and refund based on our Returns Policy, the refund will be based on the final price paid for the New Product, net of any discounts applied including the trade-up incentive. You will not receive any amount or value for the Old Product. We will no longer be able to return the Old Product that you surrendered for disposal. All refunds for valid returns will be paid via check payment and will take up to 10 working days to process.

4.4. Taking part in the Trade-up Program does not affect any statutory rights you may have, including your rights under the Consumer Act of the Philippines. (Without prejudice to our Rights under the Legal Disclaimer and Indemnification in the previous section). 

5. Samsung’s rights

5.1. Samsung reserves the right to:

(a) suspend or terminate or cancel or vary the Trade-up Program at its sole discretion at any time without any prior notice; 

(b) amend or vary the term and conditions from time to time.

6. How we may use your personal information

6.1. How we will use your personal information. We will use the personal information you provide to us in accordance with the terms of our privacy policy, which can be found here: https://117.p.syniva.es/ph/info/privacy/

6.2. If you wish to withdraw your consent to us processing your personal data, please contact us using one of the contact methods mentioned on the privacy policy page or via the contact options provided here.

6.3. Please note that in order to take part in the Trade-up Program, you must have a Samsung account and use it to login, or at least provide the necessary shipping information to complete an order as a Guest. As covered by our privacy policy, we share your shipping and contact information to our 3PL for the purpose of delivering the New Product, as cited in clause 2.3.

6.4. If, in the course of taking part in the Trade-up Program, you elect to opt to pay via any of the available third-party financing or microloan options, you will be redirected to the website of the finance provider. The privacy policy and terms and conditions relevant to that finance provider can be found on its website.

6.5. We will only give your personal information to other third parties where the law either requires or allows us to do so. 

7. Other important terms

7.1. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

7.2. To be eligible to participate in the Trade-up Program, you must be a Philippine resident aged 18+ (or have obtained your parent or guardian’s consent to the relevant sale for the relevant sum).

7.3. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

7.4. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by Philippine laws and any dispute, controversy or claim shall be settled by courts in Taguig City, Philippines.
